Legal brief in Farmers Branch immigration case filed on impact of ...

? As expected, the city of Farmers Branch filed arguments this week in the Fifth U.S. Circuit Court of Appeals on why they?d like another round at defending their ordinance on illegal immigration.

? As requested, they detail in a 73-page filing why their position is buttressed by a June 25th ruling by the U.S. Supreme Court on a tough Arizona law, known as SB 1070.

?? The Supremes struck down three of four portions of that law under review. The most publicized part of the law was upheld and it involves local law enforcement checks of those detained who are suspected of being in the U.S.unlawfully.

?? The city?s ordinance was first crafted in 2006 and has been struck down by lower court judges and in a ruling by a three-judge panel from the New Orleans-based appellate court.

?? Farmers Branch asked for and received a rehearing before the full court. In their brief, Farmers Branch outside attorneys also argue how another Supreme Court case out of Arizona buttresses their position. The decision is known as the Whiting case and it deals a 2007 case involving a tough state law cracking down on business licenses of employers who knowingly hire those in the U.S. illegally. ?? Attorneys representing tenants and landlords have until Aug. 30th ?to file?their brief. Oral arguments are set for September 19th.

?? Those crafting the legal crusade for the?city include Kris Kobach, the Kansas secretary of state involved in other such fights around the country. His legal adversaries include the ACLU,?also quite seasoned in these litigation brawls.
