Ballet dancer Misty Copeland has 2-book deal

NEW YORK (AP) ? Ballet dancer Misty Copeland has a two-book deal.

Copeland, 30, is working on a memoir for Simon & Schuster's Touchstone imprint and picture book for G.P. Putnam's Sons Books for Young Readers, part of Penguin Group (USA). Copeland helped break ground as an African American female soloist for the American Ballet Theatre. According to a release Wednesday by the two publishers, both of her books are scheduled for 2014.

In her memoir, Copeland is expected to describe the battles between her mother and her dance instructors while she was a teen over whether she should be allowed to pursue her career and who was her legal guardian.

Nintendo Q3 earnings show 3 million Wii Us sold, sales forecasts lowered again

Nintendo Q3 earnings report show

Nintendo's Q3 earnings report is out, and it's sold just over 3 million units of its new Wii U console (at a loss) along with 11.69 million pieces of software. The other big news is that it's adjusted sales forecasts downward -- again, after it announced they were being cut back in October. However, since the flagship console is sold at a loss, while Nintendo is predicting 17 percent lower revenue, its prediction for net income has actually moved up by eight billion yen ($87 million).

It's not all bad news however, as it's showing about $160 million in net income for the year, compared with last year's losses. The 3DS has jumped up to 29.84 million sold, while the original Wii is within shouting distance of the 100 million number. Need more numbers? Hit the source links to check out all the sales data firsthand.

America's future workers could benefit from improving a certain math skill in preschool

COLUMBIA, Mo. -- One in five adults in the United States lacks the math competency expected of an eighth grader, according to the United States Center for Educational Statistics. University of Missouri researchers identified how a lack of a specific math skill in first grade correlated to lower scores on a seventh grade math test used to determine employability and wages in adults. Intervention programs designed to overcome this early math deficiency could prepare students for later employment, help them make wiser economic choices and improve the future U.S. workforce.

"Our study made a connection between child psychology and labor economics in order to examine the roots of America's shortage of mathematically proficient workers," said lead author David Geary, professor of psychological sciences at University of Missouri. "We isolated a specific skill that has real world importance in employability and observed how that skill related to grade-school mathematical performance. By identifying a specific numerical skill as a target, we can focus education efforts on helping deficient students as early as kindergarten and thereby give them a better chance at career success in adulthood."

The particular math skill Geary identified, "number system knowledge," is the ability to conceptualize a numeral as a symbol for a quantity and understand systematic relationships between numbers. In Geary's research, having this knowledge at the beginning of first grade predicted better functional mathematical ability in adolescence. On the other hand, skill at solving math problems by counting didn't correlate to later ability. Students who started behind in counting ability were able to catch up, whereas students who were behind in number system knowledge stayed behind their peers.

"An early deficit in number system knowledge creates a weak foundation for later learning," said Geary. "That weak foundation can lead to a lifetime of problems, not limited to reduced employment opportunities. Poor understanding of mathematical concepts can make a person easy prey for predatory lenders. Numerical literacy, or numeracy, also helps with saving for big purchases and managing mortgages and credit card debt."

Geary's study involved 180 13-year-olds who had been assessed every year since kindergarten for intelligence, memory, mathematical cognition, attention span and achievement. All of these factors were controlled for in the analysis of scores on the employability tests administered in seventh grade. Demographic differences also were accounted for along with other factors.

###

The study, "Adolescents' Functional Numeracy is Predicted by Their School Entry Number System Knowledge," was published in the journal PLOS ONE. Mary Hoard and Lara Nugent, who are both senior research specialists at MU, were co-authors along with Drew Bailey, MU doctoral graduate and now postdoctoral fellow at Carnegie Mellon University. Geary is Curators' Professor and a Thomas Jefferson Fellow in the Department of Psychological Sciences in MU's College of Arts and Science.

Detroit edges closer to bankruptcy filing

2 hrs.

DETROIT - At the Detroit Auto Show earlier this month, luxury was in the air. Pricey new Bentleys and Maseratis glittered - including a Maserati 2014 Quattroporte with a $132,000 price tag; U.S. Cabinet Secretaries and dignitaries rubbed shoulders; and many of the well-heeled attendees ponied up for a $300-a-ticket black-tie charity ball.

But in a city that is slowly dying, the glitz didn't extend much beyond the Cobo Center exhibition hall.?General Motors Co. and Chrysler, which along with Ford Motor Co. gave the Motor City its identity, survived near-death experiences after filing for bankruptcy during the financial crisis.?

Now, Detroit itself is edging closer to a similar precipice, only unlike the automakers, its chances of getting a federal bailout are almost nonexistent.

The story of Detroit's decline is decades old: Its tax revenue and population have shrunk and labor costs have remained out of whack. But the city's budget problems have deepened to such an extent that it could run out of cash in a matter of weeks or months and ultimately be forced into what would be the largest-ever Chapter 9 municipal bankruptcy filing in the United States.

Frustrated by the lack of concrete progress, Michigan Governor Rick Snyder, a Republican, last month appointed a team to scour the city's books. The audit could result in a state takeover of Detroit's finances through the appointment of an emergency financial manager. Such a manager, who would seize control of the city's checkbook, could then propose federal bankruptcy court as the best option.

Snyder, who has called the situation "a crisis in terms of financial affairs," said the team would deliver its report in February.

"Detroit is teetering on the verge of bankruptcy after the City Council has failed to make the necessary cuts to deal with having a smaller population," said Rick Jones, chairman of the Republican majority caucus in the state Senate.

Jones, who has indicated he does not favor a bankruptcy, said he would like to see an emergency manager installed to fix the city's problems. If that failed, there would be a case for finding a way to shrink the Detroit municipal area, he argued.

Detroit's population is now just over 700,000 - down 30 percent since 1990 - but the city still has to provide services to an area encompassing more land than San Francisco, Boston and the borough of Manhattan.

While Democratic Mayor Dave Bing and the Detroit City Council have moved to reduce spending and initiate some reforms to stave off a takeover, including layoffs and wage and benefit cuts, the progress may not be enough for Michigan officials and lawmakers.

Streets without lights
In the booming post-Second World War era, Detroit was America's fifth-largest city. Today, it ranks 18th. In addition to a sharp population decline, it suffers from high unemployment related to a loss of businesses, a flood of home foreclosures and a cut in state funding. That has led to shriveling revenue, leaving the city unable to afford a workforce of more than 10,000 and the surging health and pension costs that go with them and with its retirees. As a result, credit ratings on Detroit's approximately $8.2 billion of outstanding debt have sunk deeper into junk territory.

The city's labor costs, including health care and pensions, are shrinking in absolute terms but rising as a share of the budget. They are slated to drop to $968 million, or nearly 49.5 percent of the operating budget, in the fiscal year ending June 30 versus $1.14 billion, or 45.5 percent, a year earlier.

Signs of decline are everywhere - in a rising crime rate, streets without lights and block after block of abandoned buildings. The murder rate of one per 1,719 people last year was more than 11 times the rate in New York City. The jobless rate is above 18 percent, more than twice rate for the country as a whole.

A bankruptcy would be messy.

The interests of creditors would likely collide with those of labor unions wanting to protect workers' benefits, said Eric Scorsone, a Michigan State University economist who has written papers on municipal bankruptcy and on the state's emergency manager laws.

"It is going to require the players - the City Council, the mayor, the state - to be on the same page. If you go into bankruptcy with a lot of conflict and dissent, it's going to cost more," said Scorsone.

It could also be racially explosive. Detroit has the largest percentage of black people of any U.S. city, with 83 percent of the population identifying themselves as African American, black or Negro, according to the 2010 U.S. census. Most of Michigan's state government, including the governor's office, is run by white Republicans. ?

Detroit Council Member JoAnn Watson, who along with two other members of the city's all-black City Council has been resisting reform measures, said she is still hopeful of a federal bailout or an injection of state money that she claims the city is owed.

Mayor Bing would not comment for this story.

Consequences
The automakers have little to say publicly about the crisis. Most of their operations in Michigan are now outside Detroit, and getting any top executive to even discuss the possibility of a city bankruptcy was almost impossible at the auto show. "I don't want to get into the politics," said GM CEO Dan Akerson, while Chrysler CEO Sergio Marchionne said: "I don't see what the consequences would be for us."

One of the city's biggest challenges is its complex set of labor agreements with a whopping 48 bargaining units that represent most of the city's workforce.

Max Newman, a bankruptcy attorney at Michigan-based Butzel Long, said a Chapter 9 bankruptcy could help the city throw out its collective bargaining agreements with unions.

Costs would have to be tackled since Detroit cannot just jack up taxes to reduce the cumulative budget deficit, which grew to $326.6 million in fiscal 2012 from $196.6 million in fiscal 2011. The state would likely resist tax increases, and they might only make matters worse anyway. "If taxes go up any further it would exacerbate the flight out of the city," Newman said.

But for some of those who have seen Detroit struggle for years, bankruptcy is starting to look like the least awful option - even though it will be painful.

"I think...off and on, that it wouldn't be a bad idea," said former Ford chief financial officer Allan Gilmour, now the president of Detroit's Wayne State University. "Let's clean this out once and for all."

Additional reporting by Deepa Seetharaman and Paul Lienert in Detroit.

Zac Brown Band to perform at Daytona 500 concert

NASHVILLE, Tenn. (AP) ? Zac Brown hasn't put together the set list for his Daytona 500 kickoff concert next month, but he's got a pretty good idea of how it will go.

"It would have to be up-tempo, rockin'," Brown said, "... tryin' to get everybody pumped up for the race."

It's a pedal to the metal kind of time for the group over the next month.

First up: the Grammy Awards, where the band is up for country album of the year on Feb. 10 in Los Angeles.

Brown said band members are excited about a return to the show, where they won best new artist in 2010.

"It's the awards show. It is the one," Brown said. "The other ones, there's a lot of politics, in my opinion. This one is legitimately chosen by your peers as an artist. I think you're judged by your music at the Grammys."

Then it's on to Florida for the Feb. 24 Daytona 500, NASCAR's season-opening race. The seven-piece band will play a miniconcert during the Budweiser Pre-Race Show, with two songs aired live.

Like the Grammys, it's a milestone moment for the band. And not just musically. Brown grew up in Georgia where the Daytona 500 is as big as the Super Bowl. Maybe bigger.

"It was always the big sporting event," Brown said. "Anytime there was major championships or major races, they were usually on TV. They were usually a part of what was going on when we were all hanging out together."

Boy Scouts of America reconsidering policy on gay members

Under the change now being discussed, the different religious and civic groups that sponsor?Scout?units would be able to decide for themselves how to address the issue ? either maintaining an exclusion of gays or opening up their membership.

Monday's announcement of the possible change comes after years of protests over the policy ? including petition campaigns that have prompted some corporations to suspend donations to theBoy?Scouts.

Under the proposed change, said BSA spokesman Deron Smith, "the?Boy?Scouts?would not, under any circumstances, dictate a position to units, members, or parents."

The?Boys?Scouts, which celebrated its 100th anniversary in 2010, has long excluded both gays and atheists. Smith said a change in the policy toward atheists was not being considered, and that the BSA continued to view "Duty to God" as one of its basic principles.

Protests over the no-gays policy gained momentum in 2000, when the U.S. Supreme Court upheld the BSA's right to exclude gays.?Scout?units lost sponsorships by public schools and other entities that adhered to nondiscrimination policies, and several local?Scout?councils made public their displeasure with the policy.

More recently, amid petition campaigns, shipping giant UPS Inc. and drug-manufacturer Merck announced that they were halting donations from their charitable foundations to the?Boy?Scouts?as long as the no-gays policy was in force.

Also, local?Scout?officials drew widespread criticism in recent months for ousting Jennifer Tyrrell, a lesbian mom, as a den leader of her son's Cub?Scout?pack in Ohio and for refusing to approve an EagleScout?application by Ryan Andresen, a California teen who came out as gay last fall.

"An end to this ban will restore dignity to countless families across the country, my own included, who simply wanted to take part in all?scouting?has to offer," Tyrrell said. "My family loved participating inscouting, and I look forward to the day when we might once again be able to take part."

Many of the protest campaigns, including one seeking Tyrrell's reinstatement, had been waged with help from the Gay & Lesbian Alliance Against Defamation.

"The?Boy?Scouts?of America have heard from?scouts, corporations and millions of Americans that discriminating against gay?scouts?and?scout?leaders is wrong," said Herndon Graddick, GLAAD's president. "Scouting?is a valuable institution, and this change will only strengthen its core principles of fairness and respect."

(AP) ? President Barack Obama will meet with police chiefs from three communities that have experienced mass shootings, part of his administration's push to address gun violence.

Obama is drawing attention to the worst shootings of 2012, inviting the police chiefs from: Aurora, Colo., where 12 were killed in July; Oak Creek, Wis., where six died in a Sikh temple assault: and Newtown, Conn., scene of the most recent mass tragedy that left 20 first-graders dead.

A White House official says representatives from the Major Cities Chiefs Association and the Major County Sheriffs Association will also participate in Monday's White House meeting.

Vice President Joe Biden, Attorney General Eric Holder and Department of Homeland Security Secretary Janet Napolitano will attend.

The official spoke on condition of anonymity to discuss the meeting publicly.

MacGyver Challenge Winner: Hang Your Magazines

MacGyver Challenge Winner: Hang Your MagazinesIn this week's MacGyver Challenge, we asked you to hack something cool with a clothes hanger. We received some great entries, but the winning hack shows us a simple way to store your magazines that anybody can make use of right now.

Check out the description of the winning entry below and read about some of our other favorite entries.

Winner: Hang Your Magazines

Kim wanted an out of the way space to store magazines she was reading and settled on using a clothes hanger for the job. Not only can she hang them up instead of leaving them lying around, but the hanger also serves as a bookmark. What we like about this hack is that it's something anyone who reads magazines could make use of right now. We could also see it being used in some clever ways. You could even create a more permanent magazine rack in any cabinet or shelf where you could fit a tension shower rod. Dress it up with some nice looking hangers and you're good to go. We're thinking wooden pants hangers with the clip for holding the magazine in place better.

Honorable Mentions

We got a lot of great entries and we'd be remiss if we didn't share some of our favorites. Here are some of the entries that really impressed us.

Organize Your Cables

MacGyver Challenge Winner: Hang Your MagazinesBeers was unhappy having his cables stashed in boxes and hit upon the idea of using wire clothes hangers to organize them instead. He just wraps one end of the cable around the hanger with a half hitch and lets the other end dangle, coiling cables that are extra long. The cords don't tangle and it's easy to scan the row of cables and spot what you need.

Create Your Own Indoor Basketball Hoop

MacGyver Challenge Winner: Hang Your MagazinesReader joey_nz created this indoor basketball hoop using a wire hanger and normal string. For knotting the string, he used a method for making fish nets and just left the end open. He stretches the wire hanger out and rotates the hook end for fitting over the door. The best part? When he's not using the hoop, he can close up the loop a bit, rotate the hook back, and hang it up out of the way in his closer.

Keep Your Hotel Curtains Closed

MacGyver Challenge Winner: Hang Your MagazinesDonovan shares this simple little hack that we just can't believe we didn't think of before. Hotel curtains are notorious for not closing all the way, letting in that annoying streak of light from parking lot lights, passing traffic, and the morning sun. Undaunted, Donovan used something that is handy in most hotel rooms?a hanger with clips?to keep those curtains closed and get some sleep.

Hang a Hand Truck Out of The Way

MacGyver Challenge Winner: Hang Your MagazinesReader ASC often needs to haul heavy boxes to the post office. He's found a cheap IKEA dolly that is perfect for the task, but was frustrated that it was always in the way in his tiny apartment. Not only does it take up space, but it's on wheels so propping it against the wall isn't really an option. To solve his problem, ASC reshaped a clothes hanger by bending both sides backwards and then pushing them down to form a hook. It took him no time at all and now he can hang the dolly wherever he likes.

Hang Your Off-Season Bicycle Tires

MacGyver Challenge Winner: Hang Your MagazinesReader robogrobo needed a better way to hand his Summer bike tires during the Winter season. His solution? The wire clothes hanger, of course. He bent it according to his handy illustration using the edge of a table to make bending easier. He made the same bends on both sides of the hanger to give him a perfect two-pronged hook capable of holding his tires through the long Winter months.

Extend Your Reach

MacGyver Challenge Winner: Hang Your MagazinesWe got a lot of entries about using a clothes hanger to extend your reach, but the one we couldn't resist sharing is the cutest. Steven sends us this picture of his 19 month-old (possibly our youngest life hacker) using a clothes hanger to reach that pesky light switch.

A big thanks to everyone who took the time to send us entries! Be sure to check back every week for a new challenge.

McCain: Immigration plan to have pathway to citizenship

Two senators at the center of negotiations over comprehensive immigration reform, Sen. John McCain (R-Ariz.) and Sen. Bob Menendez (D-N.J.) said on Sunday that a pathway to citizenship is an essential component of a comprehensive reform bill.

"That has to be also part of it," McCain told ABC News' Martha Raddatz on "This Week" when asked whether a pathway to citizenship would be a component of reform. "There's a new appreciation on both sides of the aisle including, maybe more importantly on the Republican side of the aisle, that we have to enact comprehensive immigration reform."

Like "This Week" on Facebook here. You can also follow the show on Twitter here.

McCain said that a small group of Senators will release the principles of a comprehensive, not "piecemeal," reform bill this week.

"I'm very pleased with the progress," McCain said. "It's not that much different from what we tried to do in 2007."

Read a full transcript of the interview with Sens. McCain and Menendez HERE.

Menendez, who met with President Obama on Friday along with other members of the Congressional Hispanic Caucus leadership, said that the president expressed his full commitment to reform.

"The president made it very clear in that discussion that this was a top legislative priority for him in this session of the Congress and that he expects to work with all of us in an effort to achieve that goal and he's fully committed to it."

He added that a pathway to "earned legalization" is an "essential element" of an immigration reform bill.

"First, Americans support it in poll after poll. Secondly, Latino voters expect it. Thirdly Democrats want it. And fourth Republicans need it," Menendez said.

McCain added that he believes Obama's use of the presidential podium on behalf of immigration reform at an event in Las Vegas planned for Tuesday will aid efforts to pass a bill.

"I think it helps," McCain said. "I think its important that we all work together on this."

"Believe it or not, I see a glimmer of bipartisanship out there," he added.

Leading Senate liberal Harkin of Iowa to retire

DES MOINES (Reuters) - Senator Tom Harkin, a veteran Iowa Democrat and one of the most liberal senators, said on Saturday he will not seek re-election in 2014, putting at risk what was considered a safe Democratic seat.

Harkin, 73, who has focused much of his nearly 40-year congressional career on farm policy, education and expanding rights for people with disabilities, is the third senator facing re-election next year who has announced his retirement, following Democrat Jay Rockefeller of West Virginia and Republican Saxby Chambliss of Georgia.

"I don't by any means plan to retire completely from public life at the end of this Congress," Harkin said in a statement. "But I am going to make way for someone new in this Senate seat. I think that is right not just for me, but for Iowa, as well."

Iowa, the site of the early presidential caucuses, is considered a political swing state. Republican Charles Grassley is Iowa's other U.S. senator.

At hastily arranged remarks to the Iowa Democratic Party central committee after his announcement, Harkin said he would stay active.

"I'm not quitting today. This is not a time for legacy talks or anything like this," said Harkin, who has served in Congress since 1974. Several committee members had tears running down their cheeks as he spoke.

Senate Majority Leader Harry Reid, a Nevada Democrat, in a statement described Harkin as "a passionate progressive, whose deeply-held principles have provided a guiding light to Democrats for decades."

Party officials said Harkin's announcement, coming early in the current two-year election cycle, provides ample time to recruit a strong Democratic candidate.

Of the Democrats, U.S. Representative Bruce Braley is widely seen as a front-runner, while U.S. Agriculture Secretary Tom Vilsack, a former Iowa governor, and his wife, Christine Vilsack, who ran unsuccessfully for Congress last year, are also viewed as potential candidates.

Among Republicans, U.S. Representatives Tom Latham, a moderate, and Steve King, a conservative, were mentioned as possible candidates, which could produce a divisive Republican primary.

Democratic President Barack Obama won Iowa in the November election but the state has a Republican governor, and a divided legislature and congressional delegation.

Harkin's retirement "just reinforces our belief that a grassroots Republican comeback can take place in 2014. Let's have it start in Iowa," Iowa Republican Party Chairman A.J. Spiker said in an email appeal to state Republicans.

Republicans need to pick up six seats in the mid-term elections next year to take a majority in the 100-member Senate.

One of the last of the Senate's old guard liberals, Harkin angrily opposed the White House over the recent fiscal cliff compromise that Vice President Joe Biden negotiated with Senate Republican leader Mitch McConnell of Kentucky. Harkin said the deal that raised taxes only on the very rich helps the wealthy at the expense of the middle class.

Harkin was first elected to the House of Representatives in 1974 and the Senate in 1984.

"When the current Congress is over, I will have served in the United States House of Representatives and the U.S. Senate for a total of 40 years. After 40 years, I just feel it's somebody else's turn," he said.

NEREJ - This year will bring modest gains in all of New Englands ...

Chris Mellen, Simon Companies
Chris Mellen, Simon Companies

All signs point to a continued recovery in the commercial real estate market in New England and specifically in the Massachusetts market. Modest gains will continue to be seen in occupancy, rents and value in most commercial sectors. Although, the recovery has been slower than most would prefer, there should be a more noticeable gain in 2013, especially in the multifamily sector.

The multifamily market has been central to the economic recovery in the past year and will continue to lead it in 2013. According to the Commerce Department, builders broke ground on the most apartments Nationwide, since 2008 and multi -family construction has increased significantly in New England as a response to the strong rental demand. Over 8,000 units were permitted in 2012, and include almost 2,600 units in Boston alone. These new units in Boston consist of major new construction projects of a planned $200 million development consisting of 503 apartments in Boston's West End, 4 new apartment complexes on the waterfront and another 600 apartment units on the edge of what was the Combat Zone. This residential component will build a new vitality in the Downtown District that will open more construction opportunities.

Boston's vacancy rate is 3.6% as compared to the national vacancy rate of 4.3%, according to the National Association of Realtors. Apartment market conditions in most other New England regional metropolitan areas are also tight with Providence at a low of 3.8%. The average rents have increased across the region and depending on the submarket by 2 to 3%.

2013 will continue to see a healthy multi-family market with rents rising only slightly, due to a competitive market created by new construction.

By contrast to the multi-family market, the office sector, although improving, is still in a slow recovery. No drum rolls here yet. Though the National vacancy rate fell to 16.7%, it is still 2.7% higher than its 20 year national average of 14%. If there is good news in this sector it's that the boston office vacancy rate is more in line with the 20 year national average at 14.7%. The Boston's central business district absorbed in 2012, more than 1.2 million square feet of office space, and was in the top 10 strongest markets in the country. Two of Boston's top 2013 projects include offices for Liberty Mutual in the Back Bay and Vertex Pharmaceuticals in the Seaport District.

Leases continued to dribble in, with many small transactions, in the suburbs. As a result of this overall hesitant leasing activity, asking rents remained somewhat static, however the average suburban vacancy did end the year at a much lower 15.4%. This was due to overall suburban absorption of approximately 800,000 s/f with the largest gain centered along the Rte.128 Beltway.

Given the limited, below historic average, new construction, landlords will see modestly improved occupancy, and all signs point to an office market that will continue to chug along in 2013. No significant increase in rents will occur and any increase in property value will continue to result because of low interest rates. Traditionally wanting to stabilize properties with long term leases, landlords, would do well to limit the length of new leases and renewals in anticipation of a more active recovery in 2015.

Out of 200 U.S. retail markets, Boston placed #13 with a 6.9% vacancy rate. This compares to a national average vacancy rate of 10.7%. For the second year in a row, The New England retail sector was a bright spot, along with the multi family sector.

Holiday Sales increased in Massachusetts for the third consecutive year, contributing to a Happy New Year for the retail real estate sector, which will be reflected in additional percentage rent. Heavy discounting at the end of December contributed to the unexpected increase in holiday sales and was especially meaningful in light of the uncertainties of the "fiscal cliff".

Low vacancy has also encouraged and will continue to encourage new retail construction with soon to be completed Chestnut Hill Sq. across the street from the Chestnut Hill Mall, the first Target Store in the new Fenway Triangle in the Fenway area, a revived University Station project in Westwood, and a rejuvenated Newbury St. with an all time low vacancy rate of 3.5%. Over $2 billion of development is planned or in progress on Newbury St. and its adjacent areas, including an expanded Chanel Store, a Restoration Hardware in the old Louis Men's store building and redevelopment of the Copley Place Mall.

In 2013 we will see a stabilized vacancy rate and rents strengthening in the retail sector.

Finally, the industrial market improved considerably in 2012 with a major decline in vacancy. The warehouse sector experienced the most gain in occupancy with a decline in vacancy rate from 16.9% at the end of 2011 to 11.6% by the end of 2012. Flex and research/development, although experienced a lot of leasing activity, dropped from 16.8% to only 15.9% during that same period. This compares to an overall national industrial vacancy rate of 10.8% for both sectors.

Most of the leasing activity in the Boston and Massachusetts markets are being fueled by technology and life sciences. Nine out of 10 of the major biopharmaceutical companies have major research facilities in the Greater Boston market and many are expanding their local research and development operations which will require additional space.

Greater Boston will continue to see a dramatic expansion of the biotech sector in not only Cambridge but in Boston's Seaport District. New biotechnology related buildings under construction or recently completed included 4 in the Biotech corridor in Cambridge, 1 in the Longwood Medical Area, 1 in the Back Bay, 3 in the Seaport's Innovation District including a reuse of a rooftop for an organic farm. Biogen, Pfizer and Vertex Pharmaceuticals continued to be the leaders in the R&D expansion effort.

Arguments in first J&J hip implant trial begin in Los Angeles

Los Angeles (Reuters) - Johnson & Johnson was aware of defects when it started selling its now-recalled metal hip implants in 2004, lawyers said on Friday during opening arguments in a personal injury trial against the company.

More than 10,000 lawsuits have been filed against J&J after its DePuy unit recalled the all-metal ASR hip implants in 2010 following recognition that they were failing at higher-than-expected rates.

Opening arguments were heard in the first case to reach trial. The suit was filed in California Superior Court by 66-year-old Loren Kransky, whose ASR hip was replaced early last year.

"I'm sure that ultimately there will be some sort of global settlement," said Georgene Vairo, professor of law at Loyola University in Los Angeles. "But they are going to litigate some cases. Even though it was clear that something was wrong with the product, that may not be the cause in each individual claim."

Kransky's attorney, Michael Kelly, said the ASR hip caused elevated levels of cobalt and chromium in Kransky, while J&J lawyers said the amount of metals shown in tests was not high enough to cause health problems.

"Doctors relied 100 percent on DePuy and patients relied 100 percent on doctors and information was kept from them," said Kelly.

Lawyers for J&J contend that Kransky, a lifelong smoker suffering from diabetes and eventually kidney cancer, was in extremely poor health, mainly caused by vascular disease, well before he received the ASR hip.

"The evidence will show that DePuy is a good and conscientious company," said J&J attorney Alexander Calfo.

He said the doctor who removed the ASR implant from Kransky will testify that he was "coached" by the Kransky family and its lawyers to use certain phrases, including the implication of metal poisoning, in medical records of the procedure.

With wear, all-metal implants can shed metal where two components connect, potentially damaging bone and soft tissue.

The U.S. Food and Drug Administration last week issued a proposal calling on companies that make all-metal hip replacements to provide additional information proving they are safe and effective before being allowed to continue selling them.

The metal implants were developed to be more durable than traditional implants, which combine a ceramic or metal ball with a plastic socket, but concerns have grown after they were shown to fail more often.

As many as 500,000 American are estimated to have received metal-on-metal hip replacements.

The state of small business lending | REJournals.com

Senior Vice President-SomerCor 504

The Small Business Administration recently finished its fiscal year, and it was a record year on most all accounts. During fiscal year 2012, more than $1 billion in SBA loans were approved for small businesses in the State of Illinois alone. This represents a substantial increase over 2011.

The impressive results in 2012 can be attributed in great part to business? appetite for attractively priced alternative financing options and the success of a two-year refinancing initiative that was part of the SBA 504 Loan program.

At the same time, since the end of September a powerful misconception has emerged and lingered in the market.? There are people?small business owners and those who advise them ? who believe that the Small Business Administration no longer is funding transactions ? that it is closed for business.

That couldn?t be farther from the truth.

Let?s clarify the state of small business lending as we close out calendar 2012 and look ahead to 2013.

Two years ago the Jobs Act of 2010 was ratified to provide small businesses with greater access to capital to invest in fixed assets. Through the SBA 504 lending program, small businesses finance the purchase, construction and renovation of commercial real estate (as well as the acquisition and installation of heavy machinery and equipment) through long-term, government-guaranteed loans.

The Small Business Jobs and Credit Act of 2010 enhanced the existing SBA loan program with three significant changes:

  • Greater access ? To qualify for a 504 loan, the tangible net worth of a company was increased to $15 million (from $8.5 million), while after-tax net income as high as $5 million (up from $3 million);
  • Increased loan values ? Applicants are eligible to receive between $5 million and $5.5 million in SBA dollars (up from between $1.5 million to $4.0 million); and
  • Debt refinancing ? Existing debt can be refinanced. Recent modifications removed certain restrictions and meant that refinancing of the debt would be possible regardless of the loan maturity.

The final change ? the refinance provision ? carried with it an expiration. The end of September brought about the end of the refinancing program.

Yet small business lending is alive and doing very well in Illinois, and across the country. The first two changes to the Jobs Act of 2010 remain in full force today. Those two characteristics, along with the fact that interest rates continue to be at some of the lowest levels ever, make SBA lending as attractive as ever.

In a traditional SBA 504 loan, a bank provides the first mortgage at 50 percent of the eligible financing, a Certified Development Corp. (CDC) like SomerCor provides a second mortgage equal to 40 percent of the eligible financing, and the borrower puts 10 percent down.? Conventional lending often calls for 25 to 35 percent down in this market, so the out-of-pocket savings is significant.

The current SBA lending programs provide advantages to both banks and borrowers.? For banks, it brings exposure down to 50 percent at a time when financial institutions are looking to preserve capital and keep their loan to values at conservative levels.? For business owners, rather than putting 25 to 35 percent down for a five-year conventional loan, the business owner can put down just 10 percent, and use the savings for working capital needs.

Additionally, the SBA portion of the 504 loan is a 20-year fixed rate that currently is 3.95 percent.

The three new elements of the legislation will impact business owners in a number of ways:

  • This increase in size standard requirements means that middle-market firms have greater access;
  • By increasing the amount of money that can be borrowed, the purchasing power of businesses has increased significantly, and the program can be utilized for projects as large as $15 million to $20 million.

Exemplifying the benefits and advantages of the SBA lending program, and the various changes that have taken place over time, is St. Charles-based Tek Pak Inc. Formed in 1992, Tek Pak sells, manufactures and distributes plastic carrier tape and thermoform prototype and production tooling to customers in the electronics and healthcare industries, among others.

Tek Pak Inc. has been the beneficiary of three SBA 504 loans, and is working on another.? Tony Beyer, president, said the SBA 504 program has allowed Tek Pak Inc. to continue to expand its operations.

Tek Pak Inc. first used a 504 loan four years ago to acquire its St. Charles facility.? ?Last year, the company used two new SBA 504 loans for equipment.? One of those loans led to the purchase of additional manufacturing equipment and the second was used to refinance term debt on other manufacturing equipment.

The company is currently in the process of obtaining its fourth 504 loan in order to acquire a facility in Batavia that it currently leases.?This new 504 loan will allow Tek Pak Inc. to continue to make capital expenditures, grow and hire additional employees.

Gabe Beukinga is a senior vice president and team leader for SomerCor 504, a Certified Development Corp. During fiscal year 2012, no Chicago-based CDC approved more SBA loans than SomerCor 504. In FY 2012, Beukinga contributed more than $90 million in SBA lending ranking him among the highest of all loan officers in the country.

[EMBARGOED FOR JAN. 24, 2013] Pediatric rotavirus vaccination also indirectly protects unvaccinated adults from the highly contagious cause of severe diarrhea and vomiting, suggests a new study published in Clinical Infectious Diseases and available online. The findings suggest pediatric immunization against the virus may be more cost effective than previously thought, given rotavirus-related health care costs among adults.

Before the vaccine, rotavirus caused an estimated 24 million outpatient visits, 2.4 million hospitalizations, and 453,000 deaths in infants and young children worldwide each year. Following the introduction of the pediatric rotavirus vaccine in the United States, declines in the disease have been seen in both vaccinated and unvaccinated children.

Evan J. Anderson, MD, now at Emory University, and a team of researchers at Northwestern Memorial and Children's Memorial Hospitals in Chicago looked into whether the vaccine's benefits extended to unvaccinated adults. They compared the prevalence and genotypes of rotavirus in stool samples collected from approximately 3,500 adults before widespread implementation of pediatric rotavirus vaccination (2006-2007) with the prevalence in samples collected from 2008 to 2010. The researchers found the number of unvaccinated adults who had rotavirus was almost halved in the years after the vaccine was introduced for use in children in the U.S.

"In adults with diarrhea who see the doctor and who have testing for bacterial infections, we noticed an almost 50 percent decrease in rotavirus," said Dr. Anderson. With previous research estimating $152 million in total adult inpatient hospital charges related to rotavirus each year in the U.S., this latest data may make pediatric vaccination "much more cost effective than previously believed."

Dramatic declines in rotavirus prevalence were evident in both adults admitted to the hospital and in those treated as outpatients. The findings suggest that "vaccinating children can protect adults from rotavirus by decreasing the amount of rotavirus circulating in the community," Dr. Anderson said. Because rotavirus genotypes change from year to year, the researchers also noted that "ongoing surveillance is needed to determine whether this impact is sustained."

The positive effect of pediatric rotavirus vaccination programs on the prevalence of disease among both young and old, vaccinated or not, underscores the need to support and encourage vaccination, Dr. Anderson said. "By improving the health of children, we indirectly improve the health of adults."
